Todd Blanche Pledges Continued Enforcement Following $400 Million TikTok Settlement
Attorney General Todd Blanche described the $400 million settlement as a "fair, just and right result."
The Department of Justice announced a $400 million settlement with TikTok, ByteDance, and affiliated entities to resolve litigation regarding COPPA compliance.
The DOJ stated that TikTok has implemented measures to protect young users, such as age-related controls and enhanced parental oversight.
“Since that lawsuit was filed, as folks know, TikTok has undergone a meaningful change in ownership, leadership, management and their practices. And so, this lawsuit and the settlement of it takes into account the changes the company has made since the lawsuit was filed, which is exactly what we should be doing,”
TikTok Agrees to $400 Million Settlement with US DOJ Over Children's Privacy
Musical.ly, the predecessor to ByteDance, previously paid a $5.7 million fine for COPPA violations.
TikTok's US operations are 81% owned by a consortium of investors, while ByteDance maintains a 19% stake.
The second payment of $100 million is tied to vacating a 2019 consent decree with the Federal Trade Commission.

The U.S. Department of Justice reached a $400 million settlement with TikTok and ByteDance regarding children's privacy legislation.
The lawsuit against TikTok was filed by the Biden administration's DOJ in 2024 concerning compliance with the Children’s Online Privacy Protection Act.
The Justice Department identified the settlement as one of the largest ever achieved in a case involving the Children’s Online Privacy Protection Act.
“The department's priority is ensuring that children are protected online and that companies entrusted with their personal information meet their legal obligations. This resolution secures a substantial recovery while reinforcing the protections that families expect and deserve.”

Assistant Attorney General Brett Shumate stated that children and parents are better protected now than when the lawsuit began.
Musical.ly, the predecessor to ByteDance, previously had to pay a $5.7 million fine for COPPA violations and obtain parental consent for users under 13.
The settlement originates from a 2024 Department of Justice lawsuit alleging TikTok and ByteDance collected large amounts of data on millions of users under the age of 13.
