Legal experts weigh double jeopardy risks in Luigi Mangione state prosecution

Following his federal plea, Mangione's defense team filed a motion to dismiss his New York state case.

Judge Gregory Carro postponed Mangione's state trial to December 10 to allow both sides to file arguments regarding dismissal.

Under federal sentencing guidelines, prosecutors disclosed Mangione's sentencing range would span from 292 to 365 months, though they vowed to seek a life sentence.

“You have one that is an intentional murder, meaning: ‘I intentionally sought to kill you. This was my purpose and goal.’ And that would be the state. Whereas on the federal level, it’s different. You’re stalking someone and as a result, that causes death, but it was not your intent, as per the statute, to murder that person.”

Mangione's state trial on a second-degree murder charge had been scheduled to begin the following month

New York state Justice Gregory Carro put Luigi Mangione's state murder trial on hold to allow prosecutors time to respond to a defense motion to dismiss the case

Thompson's family said in a statement after the guilty plea that they were grateful the federal justice system had held Mangione accountable

Luigi Mangione expected to plead guilty in federal UnitedHealthcare killing case

Mangione's state murder trial is set to begin September 8.

Assistant District Attorney Joel Seidemann wrote a letter last month objecting to the possibility of a guilty plea in the federal case wiping out the state case.

Both sets of charges against Mangione carried the possibility of a life sentence.
